Xuxly Moderation and Reporting Policy
Version 2026-09-28. Effective September 28, 2026.
This Policy forms part of the Xuxly Terms of Service with Nomenas Digital LLC. The Copyright and DMCA Policy governs statutory copyright notices and counter-notices where that procedure applies. The Nonconsensual Intimate Image Removal Policy provides a separate route, with the applicable expedited timetable, for intimate depictions published without consent. A mandatory legal process takes priority over this ordinary moderation process.
1. Review is separate from publication
Creator releases and radio submissions begin as private drafts. Reviewers may approve, request changes, hold, or reject a submission. Approval does not itself publish the item; the authorized submitter must explicitly request publication. Material revisions can be reviewed separately before they replace an existing public item.
Review considers service requirements, available rights assurances, technical quality, security, and compliance. It is not a certification of ownership, a guarantee of lawful use in every territory, or an undertaking to monitor every lyric or every moment of an external live stream. The submitter remains responsible for the rights promised in their agreement.
Xuxly currently provides profiles, following, playlists, and notifications, not a public-comment or private-messaging service.
2. What can be reported
You can report suspected infringement, impersonation, privacy violations, unlawful threats, malware, deceptive activity, manipulated engagement, inaccurate rights information, or other material violations. Use the reporting route provided on the relevant public item or email legal@xuxly.com. Ordinary technical support may be sent to support@xuxly.com.
Identify the affected item and URLs, explain the concern, and provide a contact route and relevant evidence. Avoid unrelated sensitive personal information. Legal and copyright reports can be sent by email without registering an Account. Report forms may apply authentication or rate limits where appropriate, but those controls are not a basis for refusing a legally sufficient notice through the designated contact route.
3. How a report is considered
We may review the report, compare it with available information, request clarification, seek a response from the submitter, and preserve relevant records. Filing a report does not automatically remove the target, and a larger volume of complaints is not proof that a claim is correct.
Possible actions include taking no action, requesting a correction, restricting discovery or a feature, disregarding artificial activity, hiding an item, removing media, or suspending or terminating an Account. The response depends on seriousness, evidence, recurrence, actual rights, urgency, and operational constraints. Deliberate abuse or urgent legal and security issues may justify immediate restriction.
Where appropriate and lawful, we notify the affected person of the decision and the available review route. Notice or details may be limited to protect an investigation, security measures, confidential information, another person's rights, or compliance with a legal restriction. This exception is not a general promise of unreviewable decisions.
4. Ordinary review requests
An affected submitter or reporter may request reconsideration by emailing legal@xuxly.com, identifying the decision and providing the relevant explanation or new evidence. We ask that ordinary review requests be made within 30 days of notice so they can be investigated efficiently. This requested period does not shorten a statutory counter-notice, privacy appeal, court, or other mandatory legal deadline.
We may uphold, change, or reverse a decision and may decline repetitive requests that contain no new material information. We do not promise a fixed response time or a particular outcome. A time limit required by applicable law remains controlling.
5. Withdrawal is not the same as a rights complaint
A Creator or Radio Operator can request ordinary withdrawal under their agreement. The ordinary removal window is up to 30 days after a sufficiently identified, authorized request. Alleged infringement, compromised streams, binding orders, and urgent safety or security problems use the faster process appropriate to that issue.
Ordinary removal does not recall valid earlier Downloads. Xuxly does not remotely erase Local Files or music files on listeners' devices. It can prevent future access or delivery through systems under its control, subject to applicable rights and law.
6. Records and fairness of reporting
Material review, publication, restriction, and takedown decisions are recorded. Necessary evidence may be kept for rights management, security, and legal defense according to the approved Privacy Policy retention schedule, rather than kept indefinitely merely because it once appeared in an audit log.
Knowingly false evidence, abusive mass reporting, or attempts to evade a justified restriction can themselves lead to action. A good-faith report or appeal is not abuse merely because it is rejected. AI production alone is not grounds for rejection under this Policy; the rights, legality, authenticity of factual claims, and applicable feature requirements remain relevant.
