Xuxly Nonconsensual Intimate Image Removal Policy
Version 2026-09-28. Effective September 28, 2026.
This expedited route is separate from the copyright and DMCA process.
1. What this process covers
Xuxly is operated by Nomenas Digital LLC. Although Xuxly is a music service, submitted artwork and profile images can raise issues separate from audio licensing. This process allows an identifiable person, or someone authorized to act for them, to request removal of an intimate visual depiction published without that person's consent, including a qualifying realistic digital forgery.
You do not need a Xuxly Account or ownership of copyright in the image to make this request. An AI production method alone is not the issue; this process concerns the depicted person's lack of consent to the relevant publication.
2. How to request removal
Email legal@xuxly.com, preferably with the subject Intimate image removal request, and include:
- A physical or electronic signature of the depicted identifiable person or a person authorized to act on their behalf.
- Identification of the depiction and enough information for us to locate it, such as the Xuxly page and image URLs.
- A brief statement that the depicted person believes in good faith that publication of the identified intimate depiction is not consensual, including relevant information about the lack of consent to publication.
- Information sufficient for us to contact the depicted person or their authorized representative.
A typed name can serve as an electronic signature where legally effective. You may explain your authority if acting for someone else. Do not send unrelated identification records or unnecessary copies of sensitive images when the location can be identified without them.
Consent to making an image or sharing it privately is not necessarily consent to its publication on the Service. If you are reporting another kind of privacy, impersonation, or rights problem, the same email address is available; identify the concern accurately.
3. What happens next
We review and route these requests separately from ordinary support, creator withdrawal, and copyright counter-notices. Where the TAKE IT DOWN Act applies to the Service and request, we remove the depiction as soon as possible and no later than 48 hours after receiving a valid removal request, and make reasonable efforts to identify and remove known identical copies as required by that Act. Other applicable legal deadlines also remain controlling.
We may seek information reasonably necessary to address an unclear request, but do not require a copyright claim, a Xuxly Account, or a court order as a substitute for an otherwise valid request under this process. The ordinary 30-day creator-withdrawal period does not delay this route.
Removal covers relevant access and materials within our control. It does not promise remote erasure of files already obtained by others. Necessary evidence may be preserved with restricted access under applicable legal requirements and the approved Privacy Policy retention schedule.
4. Confidentiality and other procedures
We use request information to investigate, respond, enforce applicable rules, and satisfy legal duties. We limit disclosure of sensitive details to what is reasonably needed for those purposes or required by law. Do not assume complete anonymity can be guaranteed in all legal proceedings.
The DMCA counter-notice restoration timetable does not automatically require restoration of an image independently restricted under this process. A good-faith request will not be treated as abuse merely because a factual or legal disagreement remains. Knowingly fabricated requests or evidence can be addressed under the Acceptable Use Policy.
