Xuxly Acceptable Use and Anti-Abuse Policy
Version 2026-09-28. Effective September 28, 2026.
This Policy forms part of the Xuxly Terms of Service with Nomenas Digital LLC. It applies to Accounts, submitted Content, station listings, downloads, reports, public profiles, playlists, and access to the Service. Capitalized terms have the meanings in the Terms.
1. Rights, identity, and lawful material
Do not submit, publish, or use material in a way that infringes copyright, privacy, publicity, trademark, or other applicable rights. Do not falsely claim to own a recording, impersonate a real person or business, fabricate an endorsement, or use another person's identity or voice where required permission is missing.
Do not submit nonconsensual intimate images or qualifying realistic intimate-image forgeries, unlawful sexual exploitation material, malicious software, stolen credentials, unlawful threats, or material used to facilitate fraud or other illegal activity. Do not disclose private personal information for abuse, target another user with unlawful harassment, or use profiles and submissions for deceptive schemes.
An artist name, fictional character, stylized narrative, or creative use of a synthetic voice is not automatically impersonation. Context and applicable rights matter. Expressive music, adult language, fictional violence, and controversial themes are not automatically prohibited merely because they are uncomfortable or AI-assisted. Content must still satisfy applicable law, rights requirements, and the specific rules for the feature through which it is submitted. Where an explicit-content field is requested, complete it accurately.
2. AI and production methods
AI-assisted or AI-generated material is not prohibited solely because of the method of production. Xuxly does not impose a blanket public AI label on every song or album under this Policy. Creators remain responsible for necessary permissions, truthful factual claims, and compliance with any specifically applicable legal disclosure or provenance requirement.
Do not submit fraudulent evidence of human authorship or ownership, falsely present a synthetic performance as an actual recording of an identifiable person, or remove rights or provenance information in circumstances where doing so is unlawful. This Policy does not establish copyright in otherwise unprotected material.
3. Account and system abuse
Do not sell, rent, trade, or share Accounts or credentials; evade an actual suspension; submit deceptive identity or eligibility information; access another person's private drafts or data; bypass authentication; or interfere with operation of the Service.
Do not introduce malware, exploit the Service to attack others, overwhelm an endpoint, circumvent a security or bandwidth control, or probe systems outside the scope of an express authorization or applicable law. Report suspected security problems privately to legal@xuxly.com without unnecessarily accessing, retaining, or publishing other users' information. This reporting route does not itself authorize intrusive testing or create a bug-bounty promise.
4. Artificial engagement and copying
Do not generate fake plays, likes, follows, reports, chart positions, or download activity; coordinate deceptive engagement; submit spam; or conceal automated activity as genuine listening.
Do not scrape or download the catalog in bulk, share signed grants, bypass rate limits, or create a substitute catalog without appropriate authorization. Do not redistribute Downloads or use them for model training under the personal-listening license. Independent statutory rights or a separate valid rightsholder license are not removed by these rules.
5. Publication and reports
Keep required metadata and rights attestations accurate. Do not submit another person's work as yours, replace approved materials with unrelated unauthorized materials, or use misleading credits or station endpoints. Notify Xuxly when a material rights assurance is no longer true.
Do not knowingly submit false copyright claims, abusive counter-notices, fabricated evidence, or reports intended solely to interfere with a lawful account or release. A good-faith report is not prohibited simply because Xuxly ultimately disagrees with it.
6. Enforcement
Depending on the issue, Nomenas may request corrections, restrict a feature, disregard artificial activity, remove a release or listing, preserve necessary evidence, or suspend or terminate access. Urgent rights, legal, or security issues may be addressed immediately. Enforcement does not necessarily follow a fixed number of warnings.
The Moderation and Reporting Policy explains ordinary reporting and review. The Copyright and DMCA Policy controls copyright notices, statutory counter-notices, and repeat-infringer handling. The Nonconsensual Intimate Image Removal Policy provides a separate, expedited reporting route for that material. Restrictions must remain consistent with applicable mandatory law and any valid surviving Download permission. Nothing here authorizes remote deletion of your Local Files.
